What Our Trademark Registration Package consists of:
Step 1: Strategic Brand Consultation
We start with an in-depth consultation to understand your brand vision, offerings, and long-term goals. We assess your trademark’s strength, and help you determine what trademark you’d like to pursue for registration. We answer any questions you may have regarding the process and discuss what to expect as a registered trademark owner.
Step 2: Comprehensive Trademark Clearance Search (the most important part in any trademark registration process)
Many trademark applications meet their doom when they receive the dreaded Section 2(d) “likelihood of confusion” refusal. Around 1 in 5 trademark applications are refused under this type of office action. Essentially, this occurs when a USPTO examining attorney determines your mark is too similar to a pre-existing registered mark, and refuses your mark’s registration.
To avoid this common ill fate, we conduct an exhaustive trademark clearance search, analyzing databases to identify similar marks or possible issues. Then we share our findings with you in a clear and understandable analysis report and opinion letter.
If we find something likely to prevent your trademark from being registered, you’ll get another comprehensive search for your second (and even third) trademark choices - at no additional cost.
Step 3: Application Preparation and Submission
We prepare and submit your trademark application, ensuring all necessary documentation is complete and meets all legal requirements. We also act as the application’s “Attorney of Record” to handle all correspondence with the USPTO or interested third parties.
Step 4: Responding to All Office Actions (Procedural & Substantive!) and Submitting Statement of Use Filings, or Extensions of Time
In case the USPTO requests more information or issues an Office Action, we’ll draft and submit responses on your behalf, addressing any concerns to keep your application on track. These responses are included in the package, eliminating unexpected expenses down the road - unlike other trademark service providers! (We know lawyers who charge way over $2,000 just for office action responses!)
Additionally, if your application was submitted as an intent-to-use application (aka, you submit an application before you actually launch the trademark in commerce) we will file your necessary statement of use filings or requests for extensions at no additional cost as well.

The cost of Brand Buildout starts at $2,000 per trademark (depending on the number of classes of goods/services you’d like to pursue under your trademark.)
The price above does not include USPTO filing fees and other future USPTO fees which currently start at $350 per trademark, per class of goods and services.
