Why is enforcement of my trademark so important?
A trademark’s “power” is based on distinctiveness. A strong trademark is one that stands out from the competition. Once third parties start using a similar trademark as yours, well then, your trademark’s strength starts to weaken. Evidence of third party use is often used as a way to prove a mark is relatively weak. Having a weak trademark makes it harder to enforce your rights on others when you eventually choose to. If there is overwhelming use of your trademark to the point where people use your trademark as a substitute or shorthand for a particular good or service, well you can lose your trademark rights completely! This phenomenon is known as genericide. This is how Jacuzzi and Xerox lost their trademarks!
What happens if I find someone using my trademark?
We’ll be monitoring the USPTO database, but if you find an infringer yourself, you can share that with us and we’ll immediately take action by sending a cease & desist letter and, if necessary, filing a DMCA takedown request to remove infringing content from social media or websites.
Does this service cover USPTO renewal fees?
Our program tracks your deadlines and handles the renewal process. The USPTO’s official filing fees are not included in the $1,000 membership fee. With your prior approval of the filing expenses, we’ll then ensure the paperwork is completed correctly and on time.
Can I cancel anytime?
Yes! Our service is billed annually. If you decide not to renew, your coverage will end after your 12-month term. The only thing is we ask for at least 30 days notice prior to your next billing date to cancel!
